When you commission the artist Inkmaven, you agree to the terms addressed below.
GENERAL
• The Artist (Inkmaven) reserves the right to send a refund/cancel a commission at any time due to poor communication, rude or inappropriate behavior, or inability to communicate effectively, or any other reason.
• The Client (commissioner) agrees to only contact the artist about business related questions or requests via the channels set forward by the artist. Email (inkmavenart (AT) gmail (dot) com) is always an acceptable form of contact, other forms such as Notes (FA), telegram, or twitter/x DMs may also be acceptable. For various commission openings, the artist may post a list of acceptable communication methods.
• Artwork will not be started until payment is received in full. Larger-scale commissions are the only exception to this rule (i.e., anything that may require a thumbnail) and may be started once an initial payment is received. No commission, YCH, or adoptable will progress past the sketch stage until the full amount due is received by the artist.
• Refunds are given on a case-by-case basis and determined by the artist. If the commission in the lining stage or before, or if less than 25% of the commission has been completed, a partial refund will be sent. If the artwork has been started, rights to a full refund are forfeited. If the commission is cancelled during the process of the lineart/after 50% of the art is completed, no refund will be issued. If a commission is cancelled due to rude or inappropriate behavior, the commissioner will be blacklisted and barred from future commissions.
• Work will not contain depiction of illegal activities, excessive gore, or hateful images. Explicit and fetish material is considered on a case-by-case basis. The Artist reserves the right to reject any commission for any reason.
• Unless otherwise specified before the work begins, ALL rights to commissioned work belong to the artist, including the right to make prints and merchandise. While the client still retains rights to their characters within the art, the artwork and all rights belong to the artist. Clients wishing to own commercial rights to their commission may be charged an additional fee.
• Commissioners for large scale works ($200 or more) are allowed to request WIP (Work in Progress) images, but may not always be immediately offered by the artist, with the exception of reference sheets and large scale illustrations. Work in Progresses will not be shown for commissions amounting to less than $125.
• When WIPs are shown, the artist understands that requests for changes will be made. The artist will attempt to meet these requests within reason. Repeated requests, as well as requests to change content that was not visible or clear in the reference material, will result in an extra labor charge at the artist’s current rate of $50 per hour. The artist is not responsible for mistakes where a reference sheet is not available or the artwork provided does not clearly reference the necessary material. Extra labor charges must be paid before the final deliverable files (and all other applicable materials) are given to the commissioner.
• By sending payment for a commission, you agree to the Terms of Service and the contents explained in the FAQ below.
PAYMENT
• Unless otherwise specified, art with payment of less than $200 is taken in full before the commission begins. This secures your space on the artist’s queue. In the case of adoptables, All payment is taken immediately after a claim is made, before any extra work is done or any files are sent.
• For commissions larger than $200 if the commissioner prefers, payment can be split into two halves. One half (at least 50%) must be paid to secure your spot on the queue. The second half of the payment is expected when the first WIP is delivered to the commissioner. If it is not, no high resolution images, unwatermarked files, or original copies will be released to the client until all payment is received.
• If a commissioner drops out of communication during their outstanding commission which is not fully paid, the commissioner forfeits their right to final deliverables (high res images, unwatermarked files, or originals). The artist will send at least two reminders via email or other established means of contact.
• Due to Paypal's recent ToS and price changes, I will be sending invoices via Square. If you are outside the US or have other issues paying by credit card, please let me know.
FILE USAGE
• You may repost my artwork that you have paid for in full on your personal gallery or to social media, provided that you link back to my original post containing the work (if one exists) or back to my user page.
• You may NOT post my artwork on offsite galleries where you cannot link back to me, or where it is automatically copyrighted under your or another person's username! This includes sites like Deviantart. Sites like Toyhou.se that allow for a 'guest art' function are okay with proper credit and linkage.
• Commissioners may create personal prints of their commissioned work, but may not sell them for any reason. Commissioners may not distribute high resolution files or other deliverables to parties who have not read and agreed to this ToS.
